​Mergers and transactions that exceed pre-merger notification thresholds require approval from the Canadian Competition Bureau (Bureau). As part of this process, the Bureau can issue a Supplementary Information Request (SIR) to collect additional information it believes relevant to its assessment of the transaction.

While an SIR is technically voluntary, the parties are prohibited from closing the transaction until 30 days after all parties have complied with the SIR. This can be an obstacle for a transaction timeline and could result in significant consequences for the parties involved.

Responding to an SIR is often a complex exercise and requires a team of specialized and experienced counsel. The Blakes Competition & Antitrust group is repeatedly acknowledged as the leading practice in Canada.
