Our team has worked on some of the largest and most complex procurement projects worldwide and has successfully represented clients in many precedent-setting cases as well as in Canada’s largest federal government procurement litigation ever. Both public authorities (such as municipalities, provincial governments and international institutions) and private-sector clients retain Blakes to represent them in all aspects of procurement.

Recognized for our expertise and global reach, a number of large international engineering firms, the World Bank and foreign governments have relied on us to advise them on large infrastructure and procurement projects around the globe.

We regularly assist purchasing organizations in a wide variety of industries with preparing requests for proposals and tenders and other procurement documents, developing selection criteria, advising on selection of successful respondents, and preparing and negotiating contract documentation. Blakes has also advised public-sector entities on innovative approaches to procurement to carry out complex purchases and developing enterprise-wide templates in accordance with best practices. Blakes also acts for bidders on these same matters but with a different perspective.

In addition to our commercial expertise, our litigators are skilled at resolving disputes and bid protests through negotiation and litigation. We have represented clients before all levels of Canadian trial and appellate courts and administrative tribunals, including the Canadian International Trade Tribunal (CITT) and have acted on some of the most significant procurement matters in Canada. Recognizing that most clients want to avoid litigation, we regularly advise on litigation avoidance strategies and the use of alternative dispute resolution techniques.

Working collaboratively with our Infrastructure, Aviation/Aerospace, Energy, Technology and International Trade and investment specialists, we apply deep industry knowledge and experience to provide cutting-edge strategic advice and cost-effective representation on all types of procurement matters throughout the world. Representative Matters

  • Infrastructure Ontario on all aspects of the Ontario Nuclear Procurement Project, one of the most complex infrastructure projects in Ontario and one of the largest government procurement processes undertaken in Canadian history; also advising Infrastructure Ontario on several large design-build-finance-maintain projects (detention centres, data centre, transit and international sporting facilities).
  • Ontario Association of Community Care Access Centres (OACCAC) acting in two large complex projects, one involving the preparation of template procurement and contract documents for the procurement of all outsourced professional medical services and the other involving the preparation of template procurement and contract documents for the procurement of all outsourced medical equipment and supplies.
  • Legacy Village Partners in relation to their bid on the design-build-finance of the Pan/ParaPan American Games Athletes’ Village.
  • Acting for several private-sector clients, including major Canadian financial institutions, with respect to the development of template procurement documents and ongoing procurement advice.
  • Toronto Transit Commission providing ongoing legal advice in respect of procurement processes and related contract preparation/negotiation.
  • World Bank in developing and implementing template procurement and contract documents relating to the design-build-operation of solid waste facilities. Blakes advised the World Bank and a local government in the Philippines in connection with the first "live" implementation of the template bidding and contract documents, and based on that experience. We also advised the World Bank with respect to the refinement of the template documents for future use in solid waste projects funded by the World Bank.
  • AugustaWestland (EHI) v. Attorney General the largest federal government procurement litigation ever, a C$1-billion application for judicial review and lawsuit in the Federal Court concerning the replacement of Canada’s Sea King fleet.
  • Spar Aerospace v. Attorney General (PWGSC) and Toronto Transit Commission Federal Court applications for judicial review where Cascade successfully defended a double attack on its winning bid for the C-130 Hercules maintenance contract.
  • Wang Canada v. Attorney General the first procurement case in which the remedial powers of the CITT were enforced by the Federal Court.
  • Re: Dr. John Luik and PWGSC the first CITT procurement complaint in which the CITT ordered the equivalent of “punitive damages” as a result of findings of bad faith conduct by the federal government in the course of a procurement.
