Liviu's practice focuses on commercial litigation. A well-rounded lawyer with solid experience in many industries, Liviu has developed an acute expertise in public procurement matters, whether at the federal, provincial or municipal levels. His opinions on matters involving a public procurement process (including lobbying matters) are frequently sought by various businesses and organisations, both public and private. He regularly gives presentations on public procurement, including at the Quebec Bar's continuing legal education program.

Although well versed in both plaintiffs' and defendants' work, Liviu has developed over the years a particular skill-set in the pursuit of fast and efficient results for plaintiffs, whether through traditional legal action, such as monetary relief, injunctions, judicial seizures and enforcement proceedings, or through alternative dispute resolution methods, such as mediation or arbitration.

Liviu's strong interest in litigation has led him to practice in a wide range of specific legal specialities such as contract termination claims, oppression remedies, construction law, judicial review, franchising and public procurement.

He is fluent in French, English, Spanish and Romanian.

SELECT EXPERIENCE

Public Procurement

  • Successfully defended the City of Montréal against an attempt by potential bidders to halt and cancel a C$100-million snow removal public procurement process
  • Successfully challenged the attempt of a losing bidder to access the proprietary and confidential information contained in the winning bid of a major medical device manufacturer
  • Successfully represented a VoIP provider's challenge of its disqualification in the context of a public procurement process involving a health institution

Manufacturing

  • Currently represents Israel's largest food manufacturer in a multimillion dollar contract termination claim against one of its former North American distributors
  • Represented a major signage system manufacturer in a litigation with its former distributor for breach of contract

Life Sciences

  • Acted for a major franchisor in the pharmaceutical industry in a dispute against one of its franchisees surrounding the validity of a portion of its royalty clause
  • Acted for a well-known manufacturer of medical devices in its defence of an important contract termination claim

Construction

  • Acted for the plaintiff in an action for latent defects following a real estate transaction
  • Acted for a developer and manufacturer of aerospace and advanced technology product in its multimillion dollar termination claim against a significant aircraft manufacturer

Financial Institution

  • Assisted in the restructuring of a business under the Companies' Creditors Arrangement Act
  • Represented a credit-card-issuing financial institution with regards to claims under the Bankruptcy and Insolvency Act
