Simon's practice focuses on private debt transactions, acting both for borrowers and lenders. He has extensive experience structuring and negotiating syndicated facilities, alternative lender credits, asset-based loans, capital call bridges, letter of credit facilities, project financings and structured financings. In particular, he provides advice with respect to acquisition financings, including both strategic and sponsor leveraged buyouts and tender-offer financings for public companies. He has developed particular expertise in the mining sector, and has been recognized as a leading Canadian lawyer in global mining.

Simon's clients include numerous foreign financial institutions, private equity funds, corporations and law firms, who retain him to assist with the Canadian aspects of multi-jurisdictional financings.

  • Canadian Imperial Bank of Commerce in connection with senior secured credit facilities in favour of Silver Standard Resources Inc.

  • Bank of Tokyo-Mitsubishi UFJ (Canada) in connection with a number of letter of credit facilities in favour of Canadian mining companies

  • A pair of Canadian national banks in connection with senior secured credit facilities in favour of a private equity sponsor to finance its acquisition of Niobec Inc.

  • HSBC Bank Canada in connection with senior secured credit facilities in favour of a beverage bottler and distributor

  • A pair of Canadian national banks in connection with an acquisition facility in favour of a private equity sponsor to finance its acquisition of Shred-it International Inc.
  • Orvana Minerals Corp. in connection with the financing of its El Valle-Boinás/Carlés gold project in Spain
