Andrea's practice focuses on complex corporate/commercial litigation including class actions and cross-border disputes. She has acted in major class proceedings in the areas of securities, product liability, pensions, consumer reporting and e-commerce. She also represents parties to commercial arbitrations and has advised clients facing investigations in a number of regulated industries.

Since the introduction of statutory liability for secondary market misrepresentation in Ontario, Andrea has been actively defending public issuers and other defendants against class actions premised on misrepresentation claims.

She has successfully argued cases at all levels of court, including the Court of Appeal for Ontario and the Supreme Court of Canada.

SELECT EXPERIENCE

Andrea's recent representative matters include:

  • Counsel to Celestica Inc. in its successful appeal before the Supreme Court of Canada to uphold the limitation period for bringing a statutory secondary market securities class action. Trustees of the Millwright Regional Council of Ontario Pension Trust Fund v. Celestica Inc. et al. The decision makes several important observations relating to the interplay between the Ontario Securities Act and the Class Proceedings Act
  • Representing four underwriters in a securities class action relating to alleged misrepresentations under Part XXIII.1 of the Ontario Securities Act (matter is ongoing)
  • Representing a major Canadian financial institution in a proposed class action relating to alleged manipulation of gold prices (matter is ongoing)
  • Defending a major multi-national financial institution in a proposed class proceeding relating to allegations of manipulation foreign exchange benchmarks (matter is ongoing)
  • Keith Baker and UC Live v. Bell Media Inc.; successful counsel before the Court of Appeal for Ontario; a motion to strike fiduciary duty claims was upheld without leave to amend
  • Cannon v. Funds for Canada et. al, defending Appleby Services (Bermuda) Ltd. against a C$500-million class action arising from a complex tax/charitable gift program (matter is ongoing)
  • Pouyat v. Canadian Copying Collective et al., defending a collective against a proposed class action relating to the distribution of private copying levy funds (matter is ongoing)
  • Representing various parties to complex commercial arbitrations
