Dalton McGrath is a leading litigator and Partner. Dalton has extensive experience handling complex and high-profile corporate/commercial litigation, including contract, energy, class action defence, environmental and securities litigation. He has handled complex litigation for some of the world's largest companies. He also has extensive experience in all aspects of civil fraud cases and has significant experience representing special committees in internal investigations.

Representative cases include the following:

  • Advising Fortune 500 and other prominent companies on energy disputes, including representing major oil producers in disputes arising from their oil sands production and transportation operations
  • Acting for UTS Energy Corporation in successfully opposing a hostile bid by Total SA
  • Litigating, arbitrating and advising the banking and oil and gas industries on physically and financially settled derivative swap transactions, including the successful collection of over C$1.3-billion in connection with claims involving Enron Canada Corp.
  • Striking out one of the largest reported representative actions in Alberta
  • Successfully defending Imperial Oil Limited in a multitude of civil actions and a proposed class action involving Alberta's largest site contamination matter
  • Representing national and international clients, such as Saudi Arabian Oil Company, in successfully prosecuting and defending intellectual property disputes
  • Litigating several high-profile injunction applications

Dalton writes extensively and has written several articles on practice-related topics in the corporate/commercial area and is a contributing author of Halsbury's Laws of Canada, a pre-eminent legal publication. He is also a major contributing author of Barristers & Solicitors In Practice (LexisNexis) and Canadian Legal Practice: A Guide for the 21st Century (LexisNexis), both leading national practice-related textbooks for lawyers. He is also a leading author in the field of injunctive and special applications. Dalton completed an advanced trial advocacy program at Harvard Law School through the American Trial Lawyers Association, and also teaches and is an evaluator at the Canadian Centre for Professional Legal Education. He was appointed by The Law Society of Alberta and served between 2003 and 2008 on the Alberta Practice Advisory Committee, which assisted in the drafting of the new Alberta Rules of Court. Dalton is also a member of the Advisory Board of the Institute for Energy Law. He also sits on the Dean's Advisory Committee for the Faculty of Law at the University of Calgary.

Dalton frequently appears as lead counsel in all levels of courts, has extensive arbitration experience and is also a member of the Chartered Institute of Arbitrators. He is a member of various professional organizations and volunteers extensively in various community activities, including The Law Society of Alberta, Calgary Legal Guidance, the Faculty of Law at the University of Calgary, Student Legal Assistance and as an alumnus of the Terry Fox Humanitarian Award program. Dalton is also a director of Calgary Legal Guidance, a not-for-profit organization, which is Calgary's largest provider of pro bono legal advice to low-income individuals.
