Blakes Intellectual Property (IP) Group is one of the largest intellectual property practices in Canada and has repeatedly been recognized as one of the best in the world. Blakes is a very successful example of a combined law firm/patent and trade-mark agency practice that works - offering a true full-service approach to clients' business and IP issues.

Blakes has a strong track record in advising on the development, exploitation and enforcement of all forms of intellectual property. Our activities extend from a traditional intellectual property practice involving the acquisition, transfer and litigation of patent, trade-mark, copyright and industrial design rights - through personality rights and biotechnology - to advertising and marketing, food and drug and medical device regulation, entertainment, publishing, privacy, franchising and intellectual property related corporate transactions. We also have an active litigation practice in patent, trademark and copyright infringement and related licensing and regulatory disputes.

Blakes IP Group includes approximately 35 lawyers, patent agents, trade-mark agents and technical consultants, all of whom devote the majority of their daily practice to IP matters. This commitment to the practice is reflected in the fact that four of our lawyers are recognized by The Law Society of Upper Canada as certified specialists in one or more of patents, trade-marks and copyright.

Representative Matters

  • Blakes argued before the Supreme Court of Canada in favour of the constitutionality of a key provision of the Trade-marks Act.


  • Blakes advised major brand-name multinational pharmaceutical manufacturers regarding various ultrageneric drug licensing and distribution arrangements.


  • Blakes represented a multinational medical device manufacturer in its successful effort to stop the transhipment of counterfeit consumer medical devices.


  • Blakes represented a world leader in encryption technology in building an extensive patent portfolio and licensing its technology to a United States defence contractor.


  • Blakes has represented a number of clients in the resource and exploration industries on intellectual property issues relating to exploration data and techniques.


  • Despite the fact that Anton Piller orders are very difficult to obtain in Canada, Blakes has been successful recently in obtaining four such orders in a single year.


  • Blakes represented a copyright collective society in an action against a multi-chain supplier of office products and business services relating to one of the largest claims for copyright infringement of published works in Canada.


  • Blakes acted for a group representing Canada's radio stations in a Federal Court action to change the way copyright collectives calculate tariff royalties.

We also speak at conferences both in Canada and internationally and frequently contribute to IP journals as writers or editorial board members.
