Our expert presenters will review the facts of each case, the decision reached by the presiding judge(s) and how the case has been interpreted and evolved over time. They will also provide a practical analysis on how the case impacts your day-to-day work and operations.

- Highway Properties v. Kelly, Douglas and Co. – Is a commercial lease a contract or something else? Why does it matter?
- Stack v. T. Eaton – How is a trade fixture different from a leasehold improvement, and what impact does the distinction have in relation to a tenant’s lease obligations?
- Goodyear Canada v. Burnhamthorpe – What is the difference between a lease and mortgage lender priorities, and what implications arise from not ranking ahead? How can lease registration change this?

Please note that pursuant to the amendments to the Règlement sur la formation continue obligatoire des avocats (Regulation respecting mandatory continuing education for lawyers – available in French only) of the Barreau du Québec, which came into force on April 1, 2019, the status of “recognized provider” and the mandatory “recognition” of activities have been abolished.
Blakes will continue to provide you with a confirmation of participation for your records. As stipulated in the above-mentioned regulation, members must preserve supporting documents attesting their completion of training activities for a period of seven years beginning on April 30 following the end of the reference period during which such activities were completed.
