About Bernard

As a member of the Restructuring & Insolvency group in Montréal, Bernard has been involved in various major restructuring and insolvency transactions. Over the years, he has acted for several financial institutions and trustees in bankruptcy, pleading numerous cases on their behalf before the Superior Court, the Quebec Court of Appeal and the Supreme Court of Canada.

Moreover, Bernard has acted for several companies as business counsel regarding any issues that might arise on a day-to-day basis. He also practises commercial litigation.

Bernard is fluent in French and English.

Select Experience
  • Acted on behalf of Hercules Technology, Growth Capital in the Companies' Creditors Arrangement Act (CCAA) filing of Simpler Networks during which tax losses adding up to more than C$100-million were sold to a third party

  • Represented Dumoulin Group Inc., one of the most important retailers in electronic in Canada, with respect to its CCAA filing

  • Acted on behalf of Quebecor World Inc. in relation to the litigation that opposed it to Quebecor Media Inc. and in which parties had respective claims of C$44-million and C$175-million

  • Acted on behalf of David Gottlieb, as trustee to the estate of Georges Marciano

  • Acted on behalf of Credit Suisse AG., Cayman Islands Branch, as administrative agent for the banking syndicate of Aveos Fleet Performance Inc.

  • Acted on behalf of RB Energy Inc. and Quebec Lithium Inc., mining companies operating iodine and lithium mines, with respect to proceedings filed under the CCAA

  • Acted on behalf of Bloom Lake General Partner Limited and various affiliates owning one of the largest iron ore mines in Canada, in the context of proceedings filed under the Companies' Creditors Arrangement Act

In January 2014, Bernard was part of a Blakes team that received the M&A Advisor Turnaround Award in the category Cross-Border Restructuring Deal of the Year (over C$100-million to C$1-billion) for the work they performed in connection with the bankruptcy of Georges Marciano. Other firms involved in this matter were also presented with this award.

Professional Activities

Bernard is the author of a book entitled Faillite et Insolvabilité, une perspective québécoise de la jurisprudence canadienne (Bankruptcy and Insolvency: A Quebec Perspective on Canadian Jurisprudence), considered by many as being the most authoritative book on this topic in Quebec. Over the years, he also has given numerous conferences on this subject.

Bernard is a member of the Montréal and Quebec Bar Associations.
