Ontario’s New Construction Act: Managing Transitions and Effective Implementation

Since our last seminar, the first phase of amendments that focused on the modernization of liens and holdback rules came into force in Ontario. The second phase focuses on prompt payment and adjudication and is scheduled to follow on October 1, 2019.

As a result of the first phase of amendments, we are seeing the industry tackle major issues regarding the effect of the transitions on internal procedures, effective and efficient implementation strategies and its integration into new and ongoing projects and related agreements. Moreover, as October approaches, it is increasingly important to look ahead and consider what to expect from the second phase, including what steps should be taken to facilitate the effective implementation of the additional amendments.

Quebec

Please note that pursuant to the amendments to the Règlement sur la formation continue obligatoire des avocats (Regulation respecting mandatory continuing education for lawyers – available in French only) of the Barreau du Québec, which came into force on April 1, 2019, the status of “recognized provider” and the mandatory “recognition” of activities have been abolished.

Blakes will continue to provide you with a confirmation of participation for your records. As stipulated in the above-mentioned regulation, members must preserve supporting documents attesting their completion of training activities for a period of seven years beginning on April 30 following the end of the reference period during which such activities were completed.
