Six in the 6ix: Cases Every Leasing Professional Should Know

Please join us for a presentation that will examine six cases (and a few more) that are fundamental to commercial leasing.

Our expert presenters will review the facts of each case, the decision reached by the presiding judge(s) and how the case has been interpreted and evolved over time. They will also provide a practical analysis on how the case impacts your day-to-day work and operations.

This program is a must-attend for all commercial real estate professionals.

Cases and issues to be covered include:

  • Highway Properties v. Kelly, Douglas and Co. – Is a commercial lease a contract or something else? Why does it matter?
  • Stack v. T. Eaton – How is a trade fixture different from a leasehold improvement, and what impact does the distinction have in relation to a tenant’s lease obligations?
  • Goodyear Canada v. Burnhamthorpe – What is the difference between a lease and mortgage lender priorities, and what implications arise from not ranking ahead? How can lease registration change this?
