About Erich

Erich specializes in resolving tax disputes at all stages of the process, from the commencement of an audit to the courtroom. He has a track record of litigating complex commercial cases and has expertise in navigating difficult evidentiary issues. He has represented clients in provincial and federal courts at both the trial and appellate levels. 

Erich also maintains an advisory practice. He supports clients through sensitive tax audits and has experience advising on a wide range of tax issues, including transfer pricing, international tax, domestic income tax and GST/HST matters.

Select Experience

Recent representative experience includes:

  • Defending an application for certification and subsequent appeal to the British Columbia Court of Appeal in an alleged price fixing class action

  • Representing a First Nations-owned energy company in a complex C$150-million contract dispute with a service provider

  • Defending a certification motion and subsequent appeal to the Ontario Divisional Court in an alleged misleading advertising practices class action

  • Significant M&A litigation before the Ontario Superior Court of Justice regarding the termination of over C$2-billion transaction for breaches of an ordinary course covenant

  • A number of matters before the Ontario Superior Court of Justice defending professionals in the professional liability context

Professional Activities

Erich is a member of the Canadian Tax Foundation, the Ontario Bar Association, the Canadian Bar Association and the Advocates’ Society. He is currently in year three of the CPA in-depth tax program and has completed the CBA’s Tax Law for Lawyers course.
