  • Representing the pension plan administrator of the Sears Canada Inc. Registered Retirement Plan in the CCAA liquidation of Sears Canada

  • Representing United States Steel Corporation in successfully asserting its US$2-billion claim against U.S. Steel Canada in which the court provided a fundamentally revised test for the distinction between debt and equity in an insolvency proceeding under the CCAA

  • Representing a group of U.S. funds in successfully dismissing a $1.3-billion action relating to the sale and acquisition of a major telecommunications company

  • Acting as lead counsel for a technology company in a dispute relating to the design, development and construction of a solar farm

  • Representing a construction equipment manufacturer involved in a dispute relating to performance management and dealer transition

  • Acting as counsel to a power generation company involved in a construction dispute relating to the engineering, procurement and construction for a biomass conversion project

  • Representing a major transportation company in a final offer arbitration proceeding under the Canada Transportation Act

  • Representing health care providers in litigation relating to procurement, supplier management and contractual termination, including an application for judicial review and injunction proceedings

  • Acting as counsel to a multinational technology company in a class action involving Sale of Goods Act and privacy claims relating to preloaded software

  • Representing Celestica Inc. on its successful appeal before the Supreme Court of Canada to uphold the limitation period for bringing a statutory secondary market securities class action

  • Representing Visa Canada Corporation in a major resale price maintenance hearing before the Competition Tribunal of Canada

  • Acting for a large global mining client in an International Chamber of Commerce (ICC) arbitration involving the performance and termination of international supply agreements

  • Acting as lead trial and appellate counsel to a manufacturer of mobile data terminals in an action against one of its suppliers relating to defective components

  • Representing the administrator of a public pension plan in a commercial leasing dispute involving the interpretation of a retail lease at a major shopping center

  • Representing a media company in a shareholder dispute involving its acquisition of an online business

  • Acting as lead counsel to an online media company in a proceeding before the Human Rights Tribunal of Ontario relating to the enforcement of online user forum rules

  • Representing an investment banking boutique and one of its principals in a successful motion to stay proceedings based on jurisdictional grounds
