About Paulina

Paulina's practice focuses on environmental and Indigenous law, including corporate compliance and regulatory and litigation matters. She has experience with provincial and federal environmental and regulatory regimes, permitting, environmental assessments, administrative penalties and appeals and federal regulatory prosecutions. Paulina also has experience with various Indigenous law matters, including consultation, negotiation, project development and regulatory matters.

Paulina provides strategic advice to clients regarding risk management and compliance in the development of large projects. She assists with identifying and managing environmental risks and corporate compliance and due diligence matters. Paulina has significant experience in the mining, energy and natural resource sectors, as well as real estate and waste management.

Paulina has appeared before the British Columbia Provincial Court and Supreme Court.

Select Experience

Environmental

  • Providing strategic advice on environmental-related legal matters, including regulatory processes, project development and construction issues, and litigation and disputes

  • Defending clients charged with Fisheries Act offences, including successfully resolving charges through withdrawal of charges prior to trial

  • Advising mining and energy companies on a range of environmental regulatory issues

  • Advised on environmental assessment and permitting of LNG development projects

  • Representing various clients in prosecuting and defending claims for clean-up costs associated with complex contaminated sites

  • Representing clients in the investigation, defence and resolution of regulatory charges

  • Representing clients in forestry, mining and renewable energy industries with opportunities to be heard for administrative monetary penalties

  • Representing a client in a complex arbitration dispute regarding a large infrastructure project

  • Advised major energy companies on environmental assessment and permitting for a major natural gas project and pipeline transmission

  • Advising clients on a range of environmental issues regarding the development and acquisition of large-scale projects, including environmental assessments, regulatory compliance and wildlife management

  • Advising clients regarding climate change related risks

  • Advising major industrial operations on internal and external environmental compliance audits

  • Providing transactional support on environmental issues arising from mergers and acquisitions, financings and other corporate transactions

Indigenous

  • Advising clients in the natural resource sector who are consulting and negotiating with Indigenous communities affected by project development

  • Negotiating and drafting commercial agreements involving Indigenous groups (e.g. impact benefit agreements, funding agreements, etc.)

  • Providing strategic advice on Indigenous-related legal matters, including consultation and regulatory processes and environmental assessment, permitting and tenure matters

  • Advising Indigenous clients on matters related to project financing

Paulina serves as an Executive for the Canadian Bar Association (BC Branch) Environmental Law section and an Executive for the CBA (BC Branch) Natural Resources Law section. She is also a member of the Law Society of British Columbia and the CBA (BC Branch) Indigenous Law section.

Paulina frequently writes for various publications on environmental matters, including The Environment and Climate Change Law Review (Canada chapter) and Key Developments in Environmental Law.
