Some of the representative matters in which Tom has been involved include:

  • Enforcing and collecting on unpaid invoices, including in the builders' lien and Public Works Act contexts

  • Addressing rental arrears and other lease defaults for both landlords and tenants

  • Assisting in a major tax case pending before the Tax Court of Canada and arising out of transactions in oilsands assets

  • Assisting in an approximately C$500-million construction dispute pending before the Court of Queen's Bench and relating to a pipeline failure in Alberta

  • Assisting in a multimillion-dollar dispute dealing with the CAODC form of Master Daywork contract, which was successfully resolved

  • Assisting in the representation of a global EPC contractor on a C$70-million multi-party arbitration surrounding the construction of a sour gas facility

  • Acting for a Crown corporation in a C$270-million arbitrated dispute relating to delays, change orders and breach of contract during the construction of a power transmission project

  • Assisting in the representation of insurers in a C$540-million coverage dispute for business interruption and repair costs involving the refurbishment of a nuclear power facility
