Are You a Foreign Agent? Navigating Canada’s New Foreign Influence Registration Regime

Canada’s new Foreign Influence Transparency and Accountability Act introduces a significant transparency and compliance regime for individuals and organizations engaged in a broad set of activities with or on behalf of a foreign principal. The legislation establishes a public registry of foreign influence activities and creates new registration, reporting and enforcement requirements intended to make foreign involvement in political and governmental processes in Canada more transparent.

The broad definition of “foreign influence” set out in the legislation means that virtually every organization working with foreign governments, state-owned enterprises, international institutions, sovereign wealth funds, foreign public sector pension plans and other foreign-linked entities will need to quickly develop a strong understanding of the scope and practical implications of the Act.

Please note that pursuant to the amendments to the Règlement sur la formation continue obligatoire des avocats (Regulation respecting mandatory continuing education for lawyers – available in French only) of the Barreau du Québec, which came into force on April 1, 2019, the status of “recognized provider” and the mandatory “recognition” of activities have been abolished.

Blakes will continue to provide you with a confirmation of participation for your records. As stipulated in the above-mentioned regulation, members must preserve supporting documents attesting their completion of training activities for a period of seven years beginning on April 30 following the end of the reference period during which such activities were completed.
