About Tracy

Tracy’s practice is focused on the financial services industry. She has extensive experience with payments law and new payments technology, bank regulatory and policy matters, anti-money laundering, and consumer protection issues. Tracy has particular interest in the regulation of retail payments as well as FinTech, PayTech, and other innovative technologies, including blockchain, NFTs and cryptocurrency. Her combination of private sector, in-house, and regulatory experience allows her to offer practical, strategic advice to clients that minimizes legal risk while enabling them to achieve their business objectives.

Prior to joining Blakes, Tracy worked as counsel at an international law firm, and as a director at Payments Canada, where she supported ongoing efforts to modernize Canada’s national payments systems, as well as legal and policy frameworks. She has also worked as senior counsel at a major Canadian financial institution.

Tracy’s representative work includes advising:

  • Domestic and foreign financial institutions on compliance with payments system rules and codes of conduct

  • Foreign consumer lenders as they enter the Canadian retail lending market

  • Retail credit card issuers on their Canadian disclosure obligations

  • Payment card network operators, merchant acquirers and processors on the negotiation of processing agreements, referral agreements and compliance with the Canadian Code of Conduct for the Credit and Debit Card Industry

  • Reporting entities on their Canadian anti-money laundering and counter-terrorist financing obligations

  • Prepaid card issuers and distributers and credit card issuers in the negotiation of program agreements and the distribution of prepaid products in compliance with federal and provincial regulations

  • Consumer lenders on compliance with provincial licensing and consumer protection requirements

  • Payment service providers on their Canadian regulatory obligations

  • Major social media platforms on their Canadian compliance obligations
